DV Lottery Adjustment
The Diversity Immigrant Visa Program makes available 50,000 diversity t visas (DV) annually, drawn from random selection among all entries to persons who meet strict eligibility requirements from countries with low rates of immigration to the United States. Only people from certain countries are eligible to enter.
Generally the lottery begins every year on October 2 and ends by December 2. However, these timings are subject to change. During this window the applicants from various eligible countries apply for the lottery. On winning the lottery the applicant is notified by the Department of State.
If the applicant is outside United States they get the green card by going through the consular processing, however, if in United States the applicant can apply for adjustment of status here as long as they are within their valid authorized stay. The only people who are out of status and who may still be eligible to file for adjustment of status, are the ones who qualify for the 245(i) benefit.
Please note that for lottery winners, the filing for adjustment or status or going through consular processing needs to meet certain time lines. The applicant/winner can lose the benefit unless those time lines are met.
